1. Who you are contracting with
RecurrIQ (“the Service”) is provided by CacheOps LLC (“CacheOps”, “we”, “our”, “us”). By creating an account, accessing, or otherwise using the Service, you agree to these Terms & Conditions (“Terms”). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and “you” refers to that organization.
2. The Service
RecurrIQ is a AI billing intelligence product that helps you track recurring revenue, surface churn signals, and understand subscription data. Specific features available to you depend on your plan.
3. Acceptable use
You must not misuse the Service. In particular, you agree not to:
- use the Service for any unlawful, fraudulent, or harmful purpose;
- send spam, malware, or otherwise interfere with the Service;
- probe, scan, scrape, or attempt to breach the security of the Service or any related systems;
- infringe the intellectual property, privacy, or other rights of any person;
- reverse engineer, decompile, or attempt to extract the source code of the Service, except where this restriction is prohibited by law;
- resell or redistribute the Service without our written consent.
4. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and keep it up to date.
5. Intellectual property
CacheOps and its licensors retain all right, title, and interest in and to the Service, including all software, documentation, branding, and related intellectual property. We grant you a limited, non-exclusive, non-transferable right to use the Service within the plan you have selected, subject to these Terms.
6. Your data
You retain ownership of the content and data you submit to the Service. You grant us a limited license to host, process, and display that content solely to provide and improve the Service for you. Our processing of personal data is described in our Privacy Notice.
7. Payment, billing, and refunds
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, cancellations, and refund mechanics are governed by Paddle’s Buyer Terms. Refunds are handled by Paddle in accordance with the Paddle Refund Policy; our Refund Policy page summarises how that applies to RecurrIQ purchases and does not override Paddle’s policy or your statutory consumer rights.
8. Service availability
We work hard to keep RecurrIQ available, but we do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. Scheduled maintenance, third-party outages, and unforeseen incidents may affect availability.
9. Suspension and termination
We may suspend or terminate your access to the Service if you materially breach these Terms, fail to pay amounts due, present a security or fraud risk, or repeatedly or seriously violate our policies. You may stop using the Service at any time and may cancel your subscription through your account or via Paddle.
On termination, your right to use the Service ends. We may delete account data after a reasonable retention period; you are responsible for exporting any data you wish to retain before termination.
10. AI-generated outputs and analysis
RecurrIQ may use automated analysis, statistical models, and AI techniques to generate insights, summaries, and recommendations from the data you provide. These outputs:
- may be inaccurate, incomplete, or out of date and should not be treated as professional, financial, legal, accounting, or tax advice;
- are intended to assist your own decision-making and require your review and judgment before you act on them;
- must not be used to generate unlawful content, infringe third-party rights, attempt to identify individuals without a lawful basis, or circumvent technical or contractual restrictions.
You are responsible for the inputs you provide and for how you use any outputs. We may filter, restrict, or remove content and outputs where we reasonably believe doing so is necessary to comply with law, protect the Service, or enforce these Terms.
11. Disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of liability
To the fullest extent permitted by law, CacheOps and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising out of or in connection with your use of the Service. Our aggregate liability for any claim arising out of or relating to these Terms or the Service is limited to the amounts you paid to Paddle for the Service in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (such as for fraud, death, or personal injury caused by negligence).
13. Indemnity
You agree to indemnify and hold CacheOps harmless from any claims, damages, liabilities, and reasonable expenses (including legal fees) arising from your content, your use of the Service in violation of these Terms, or your violation of applicable law.
14. Changes to the Service or these Terms
We may update the Service and these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, by email or in-app notice). Your continued use of the Service after the changes take effect constitutes acceptance.
15. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles. Any dispute will be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.
